Introducing the new Bonterms DPA v2.0

Introducing the new Bonterms DPA v2.0!

With Version 2, we've done a major overhaul on usability:

  • Works with any main agreement — SaaS or other services (v1 was tied to the Bonterms Cloud Terms)
  • Schedules and Setup Page now built right into the DPA
  • Check-the-box options to tailor the processing and transfer details to your deal

But here's the part we think you'll like best. There are now three ways to deploy the Bonterms DPA:

  • Attachment — when you're entering the DPA concurrently with the main agreement and want to sign only one document
  • Signable — when you want a standalone, signed DPA in a single document
  • Cover Page — when you want your own formatting or branding, or anticipate significant changes

And we've kept what was already working great in v1:

  • Meets the processor requirements of the GDPR
  • Covers the subtle differences between the EU, Swiss and UK cross-border transfer mechanisms
  • Implements the CCPA and is expandable to other U.S. state privacy laws
  • Market-vetted terms that fill the gap between regulatory requirements and actual commercial practice — subprocessors, security incidents, audits and more

In the three years since its first release, the Bonterms DPA has stayed in our top-five downloads and enjoys widespread acceptance. After three months and seven drafts on v.2, we think the Committee has made it easier to use than ever.

Thank you, as always, to our incredible Standard Agreements Committee, with a special hat tip this time to Adam Connolly, Felicity (Flick) Fisher, Stacey Shaw and Jerry Levine.

Like every Bonterms Standard Agreement, the DPA is free to download and use.

Platform customers, you will see the new DPA automatically.

Join us for a DPA orientation session on Wednesday, July 22 at 10am PT.

As always, we welcome your questions and feedback.

PS: Because we know you'll ask — releasing a new version has no effect on any prior version you've already entered into. Version 1.0 remains available under the Prior Versions tab, and you're free to keep using it as you wish.
